Unpakt™ Privacy Policy
The Unpakt website (the “Site”) located at https://www.unpakt.com is operated by Unpakt, LLC (“Unpakt”). Unpakt is committed to respecting and protecting your privacy. To that end, we have prepared this privacy policy (this “Privacy Policy”) to describe our information gathering and dissemination practices and our data protection practices for the Site; it does not apply to other online or offline Unpakt, LLC sites, products or services. The terms “Unpakt,” “we,” “us,” and “our” refer to Unpakt and its affiliates. The terms “you,” “your,” and “yours” refer to the user utilizing the Site and/or the Service. This Privacy Policy is incorporated into and subject to our Terms of Service located within the Unpakt Service Agreement and Unpakt Membership Agreement (the “Terms of Service”), and capitalized terms used but not defined in this Privacy Policy are defined in the Terms of Service.
Collection of Information
Here's what we collect from you when you use the Service:
“User-Provided” Information: When you sign up or register through this Site for the Service, we ask you to provide certain information, including information that is considered “personally identifiable information” (that is, information that would allow us to directly identify you, such as your name, e-mail address, mailing addresses, and telephone number). We will also ask you for “non-personally identifiable information” (such as information on your household goods; including detailed item descriptions, and item or shipment values; and reviews, surveys, message board posts, compliments or other feedback that you make through the Site or that you send to us). This information is necessary to customize our Service to your needs and provide you with the most accurate quotes for your move transaction. We me also collect reviews, comments and/or surveys related to the Services. If you elect to go forward with the transaction and book a move with a participating transportation service provider, we will ask you to provide financial information, including credit card and other billing information, to process and bill you for the transaction. We will also use this financial information to verify your account, including your identity and address. Other information you may provide to us, such as through our “Submit a Request” or “Contact Us” feature.
“Automatically Collected” Information: When you use the Service, we may automatically record certain information about your use from your web browser such as your IP address. This information is used for our internal research purposes, to accommodate the Site to our customers’ preferences and needs.
“Cookies” Information: One form of "automatically collected" information we record is information stored by "cookies." When you use the Service, we may send one or more cookies to your computer. We use both "session" and "persistent" cookies to collect, store, and sometimes track various types of information. A session cookie is one that disappears after you close your browser. While a persistent cookie remains after you close your browser (and may be used by your browser when you later return to the Service), persistent cookies generally can be removed. You can review the appropriate "Help" file in your Web browser or your mobile device to learn the proper way to modify your cookie settings. We will use the information collected to improve customer experience on the Site by customizing features to our customers’ preferences and to enable customer registration. “User-Provided” Information, “Automatically Collected” Information and “Cookies” Information collectively referred to herein as “Your Information.”
Information Obtained from Other Sources: We may obtain personal information about you in connection with the Services from publicly and commercially available sources and from our Move affiliates and/or business partners (such as advertising networks or social networking services), including:
- Demographic data (such as gender, age range, educational level, household income range, number of children in household, ethnicity to the extent permitted);
- Purchasing data, including information about advertisements you have seen or acted upon and information about your interaction with advertisers’ products and services;
- Occupational data (such as profession, position, title, industry; and business address);
- If you log in with a third-party account with the Services (e.g., Google), we may obtain information about you, such as your user ID and/or user name and other information you have permitted those services to share with us consistent with your privacy settings for that third-party account.

- Location information, including the city, state and zip code associated with your IP Address, information derived through WiFi triangulation, and precise location information from GPS-based functionality on your mobile apps, with your consent;
- Your phone number and mobile carrier details in connection with our websites and mobile apps.
Information Use
We, or service providers acting on our behalf, may use the information collected from and about you to:
- Enable your use of our products and services including, without limitation, to verify your contact and account information and to process your transaction that you requested.
- Send marketing and/or promotional materials, alerts regarding available offers and other communications, including text/SMS messages if you provided your mobile number and opted in to receive such messages
- Communicate about, and administer participation in, special events, promotions, programs, offers, surveys, contests and market research;
- Respond to inquiries from you and other third-parties, including inquiries from law enforcement agencies;
- Provide technical support;
- Supplement your personal information collected directly from you and/or from automated means with additional information from publicly and commercially available sources, and/or information from our affiliates and our business partners;
- Associate your browser and/or device with other browsers or devices you use for the purpose of providing relevant and easier access to content, advertising across browsers and devices, and other operational/business purposes;

Information Sharing and Disclosure
We will not sell or rent your personally identifiable information to third parties except as described in this Privacy Policy. We may disclose or make public Your Information to other companies or people under any of the following circumstances:
- When we have your consent to share the information.
- With our Movers, Storage Operators and/or other service providers to facilitate your transactions, and other third parties for their own commercial or marketing purposes, such as to serve targeted advertisements.
- To market our brand and services through the Site or through other third-party websites or services, including, but not limited to, making your feedback regarding the Site or Service public.
- If sharing the information is reasonably necessary to provide a product or service that you have requested.
- To keep you up to date on the latest product announcements, special offers, or other information we think you would like to hear about either from us or from our business partners (unless you have opted out of these types of communications).
- If we believe in good faith that we are required to do so by law, in connection with litigation, to prevent a crime, or to protect personal safety, the public, or the Site.
- In connection with a sale or merger with another entity or if we should ever file for bankruptcy or have our assets sold to another entity.

Choice
You may also decline to share certain information with Unpakt, in which case Unpakt may not be able to provide to you some of the features and functionality found on the Service. You may update, correct, or delete your profile information and preferences at any time by editing your profile on the Site. Please note that while your changes are reflected promptly in active user databases, we may retain all information you submit for a variety of purposes, including backups and archiving, prevention of fraud and abuse, and analytics. You may also modify the cookie settings on your Web browser or mobile device to limit the information you share.
To protect your privacy and security, we take reasonable steps to verify your identity before granting you account access or making corrections to your information. YOU ARE RESPONSIBLE FOR MAINTAINING THE SECRECY OF YOUR UNIQUE PASSWORD AND ACCOUNT INFORMATION AT ALL TIMES.

We are committed to protecting personally identifiable information from loss, misuse, disclosure, alteration, unauthorized access, and destruction. Unpakt takes reasonable precautions to safeguard the confidentiality of personally identifiable information. We protect the security of your personally identifiable information during transmission to us by using software which encrypts the information you input. While we strive to protect your personally identifiable information, we cannot ensure the security of the information you transmit to us in all cases.

The Site may contain links to other sites. Unpakt is not responsible for the privacy practices of such other sites. We encourage our users to be aware when leaving the Site to read the privacy statements of each site that collects personally identifiable information.
Your Consent to this Privacy Policy
By using this Site and/or the Service, you agree to this Privacy Policy. We may occasionally update or modify this Privacy Policy, at our sole discretion. The date of the most recent update of this document will always be displayed at the end of this page. If we change our Privacy Policy, we will post those changes on this page, if the changes are significant, we will provide a more prominent notice (including, for certain services, email notification of Privacy Policy changes). If we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we will notify users via email (if an email address has been provided) or display a notice on the Site. - auditing related to a current interaction with you and concurrent transactions, including, but not limited to, counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance;
- short-term, transient use, including, but not limited to, the contextual customization of ads shown as part of the same interaction;
- detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity;
- debugging to identify and repair errors that impair existing intended functionality;

We may disclose the categories of personal information identified in this California Privacy Notice about our California consumers for our operational purposes where the use of such personal information is reasonably necessary and proportionate to achieve the operational purpose for which the personal information was collected or processed or for another operational purpose that is compatible with the context in which the personal information was collected.
Categories of Third Parties with Whom We Shared the Personal Information
The categories of third parties with whom we share personal information include our subsidiaries and affiliates, business partners, data analytics providers and third-party moving and/or storage companies, third-party marketers (who may combine your personal information with their own records and records available from other sources, for their own business or direct marketing purposes, and the direct marketing purposes of other third-party marketers.)
Categories of Personal Information Sold, Shared or Disclosed for a Business Purpose
We may sell or disclose for a business purpose any or all of the personal information collected from and about you as set forth in the Information We Collect and Obtain and Information We Share sections in our Privacy Notice above.
Sensitive Personal Information.
We do not use or disclose sensitive personal information other than geolocation data collected by our apps to provide you the Services and as permitted by California law. We do not sell or share sensitive personal information.
Retention of Personal Information.
We retain your information for as long as necessary to provide the Services to you and our other users. This means we keep your profile information for as long as you maintain an account. We retain transactional information for at least seven years to ensure we can perform legitimate business functions, such as accounting for tax obligations. We also retain your information as necessary to comply with our legal obligations, resolve disputes and enforce our terms and policies.
Your California Privacy Rights
If you are a California resident, you may have certain rights. California law may permit you to request that we:
- Provide you the categories of personal information we have collected or disclosed about you in the last twelve months; the categories of sources of such information; the business or commercial purpose for collecting or selling your personal information; and the categories of third parties with whom we shared personal information.
- Provide access to and/or a copy of certain information we hold about you.
- Delete certain information we have about you.
- Correct certain information that we have about you.
You may have the right to receive information about the financial incentives that we offer to you (if any). You also have the right to not be discriminated against (as provided for in applicable law) for exercising certain of your rights. Certain information may be exempt from such requests under applicable law. For example, we need certain types of information so that we can provide the Services to you and for compliance with applicable law. If you ask us to delete certain information, you may no longer be able to access or use the Services.
California customers may request, once per year, that we disclose the identity of any third parties with whom we have shared personal information for the third-parties’ direct marketing purposes within the previous calendar year, along with the type of personal information disclosed.

De-identified or pseudonymous data. In addition to the collection of personal data as described in the Privacy Notice, we process de-identified data. With regard to our processing of de-identified data, we take reasonable measures to ensure the de-identified data cannot be associated with a natural person and commit to maintain and use such de-identified data without attempting to re-identify the data, and we require all of our service providers and partners in receipt of such de-identified data from us treat the data in the same manner.
CONSUMER PRIVACY RIGHTS AND CHOICES
In addition to your rights of access, correction, deletion and data portability, as described in the Privacy Notice, Consumers may have certain additional rights in connection with the personal data we collect about you, many of which are subject to exceptions under applicable law:
